One example is my observer attendance at a Defense Medical Examination for a client who suffered a Temporomandibular Joint (TMJ) injury in a motor vehicle accident. The DME doctor's report asserted that the client suffered prior aggravation of her TMJ - indicating that she had stated during the defense medical examination that she previously chewed gum frequently and had pain & popping in her TMJ for years before the motor vehicle accident. My observer report and the audio recording of the defense medical examination indicated that she had told the DME doctor that she only occasionally chewed gum and had never experienced pain or popping in her TMJ before the accident. The plaintiff's attorney's office sent the DME doctor's report to me for review. I produced a brief statement that included the key inconsistencies. My refuting statement and initial attendance report were presented by the plaintiff's attorney at a settlement conference - just before the plaintiff attorney played the audio recording of the dentist asking the client the questions and the plaintiff giving the REAL answers. Refuting the doctor's untrue report was integral to achieving a favorable settlement in this case.
